Ogier senior legal manager Shane Quinn has graduated from the International Association of Restructuring, Insolvency & Bankruptcy Professionals' (INSOL) prestigious Global Insolvency Practice Course, and is now formally recognised as a Fellow of INSOL International, and senior associate Farrah Sbaiti has completed the INSOL Foundation Course in International Corporate Insolvency.
INSOL's courses are recognised as the pre-eminent advanced educational qualifications focussed on international insolvency.
Shane is a senior legal manager in Ogier’s Dispute Resolution team in Hong Kong. His practice focuses on complex and cross-border corporate insolvencies, as well as commercial litigation and trusts litigation. Shane has particular experience in applying for – and resisting applications for – freezing injunctions, the winding up of BVI companies and anti-suit injunctions.
Farrah is a senior associate Ogier's Dispute Resolution team in Cayman specialising in commercial litigation and corporate insolvency. Farrah is an experienced advocate who regularly attends court for contested interim applications, other interlocutory hearings and trials. Farrah is a member of the International Women's Insolvency and Restructuring Confederation as well as 100 Women in Finance.
Shane said: "The Global Insolvency Practice Course offered by INSOL International is truly unique in its offering, both in terms of its content and its style of delivery. The past 20 or more years have seen a huge increase in the number of insolvencies and corporate restructurings with a cross-border element. Different legislative approaches have been adopted by various countries to deal with these issues as they arise, either in out-of-court or in-court processes.
"The offshore legal market is naturally exposed to cross-border issues much more frequently than domestic legal markets and clients are increasingly looking for legal advice that can encompass an understanding of how one particular jurisdiction's insolvency or restructuring process will interact with processes in other parts of the world. In fact, the first matter I was asked to work on when I joined Ogier's Dispute Resolution team in Hong Kong involved a British Virgin Islands liquidation where the liquidators had sought recognition of their appointment in the US and Singapore. That is the exact kind of case that an INSOL Fellow is equipped to advise on."
Farrah said: "The INSOL Foundation Course in International Corporate Insolvency has provided me with a useful and practical overview of corporate insolvency and restructuring regimes in various onshore and offshore jurisdictions. The course can be tailored to cover the jurisdictions that are most relevant to any particular cross-border insolvency practice, and its self-taught format makes the course very manageable to complete alongside full-time work."
