Four of Ogier's international trusts team are among the top 100 trust litigators recommended by peers in new research by private client specialists Citywealth.
Citywealth has created the list of trust litigators who 'trustees turn to when litigation arrives on their doorstep or on the other side of the coin when families or entrepreneurs are no longer happy with their advice or service'.
Rachael Reynolds, Ogier's global head of Dispute Resolution who is herself named in the top 100 said: "We are very grateful to be put forward by our peers as those who have impressed them most during our current and past cases. The matters with which we are involved require us to deal with complex and sensitive issues in a commercial way and usually involve high-value, multi-jurisdictional structures, and our teams around the world are well accustomed to working together to achieve our clients' goals. Rachael, who is also the firm's Head of Trust Disputes, has particular expertise in contentious trust matters, fund disputes and restructuring and insolvency. Her recent cases include acting for the trustees in a complex multi-billion dollar STAR trust restructuring, and acting as advocate for HSBC in contentious trust proceedings, involving three jurisdictions, in which an important decision has been handed down dealing with surrender of discretion, public policy and issues concerning enforcement of foreign trust judgments. Rachael's peers tell Citywealth that she "strenuously defends international clients with diplomacy and cautious understanding."
William Jones, who works alongside Rachael in the Cayman Islands and was promoted to partner in April this year, is a highly experienced member of the firm's Cayman Trusts Advisory Group spanning contentious and non-contentious matters. He also has relevant commercial litigation experience, and is a member of Ogier's cross service-line Restructuring and Corporate Recovery team. Citywealth says that Will is "Hardworking, conscientious, diligent and forthright."
Jersey-based Damian Evans specialises in all aspects of dispute resolution and insolvency, with a particular emphasis on contentious and non-contentious trust cases. Damian has been involved in some of the most significant trust litigation in Jersey, including the leading Court of Appeal case which changed Jersey law on rectification of trusts. As part of Ogier's multi-disciplinary Restructuring & Corporate Recovery team, he also specialises in illiquid or insolvent trusts and formal insolvency procedures. Citywealth calls Damian "a distinguished combatant, negotiating at the highest level with global figureheads and authorities ."
Grant Carroll, a partner in Ogier's BVI Dispute Resolution team as well as the firm's global Restructuring & Corporate Recovery team, specialises in contentious and non-contentious cross-border restructuring and insolvency matters together with commercial and trusts litigation and claims involving fraud and breach of duty. Citywealth says Grant is known as an "astute, perceptive problem solver with practical dispute grounding."
