Who can benefit from my Will?

Status Movable Estate Immovable Estate
Single You may leave your movable estate to whoever you choose. You may leave your immovable estate to whoever you choose.

Single with children

 

Your children are entitled by law to ⅔ of your net movable estate.
You have free disposal of the remaining ⅓ of your movable estate.

You may leave your immovable estate to whoever you choose.

 

Married/civil partner without children

 

Your Surviving spouse is entitled by law to the household effects plus ⅔ of your net movable estate.
You have free disposal of the remainder of your movable estate.

Your Surviving spouse is entitled by law to life enjoyment of ⅓ of your immovable estate.

 

Married/civil partner with children

 

 

Your Surviving spouse is entitled by law to the household effects plus ⅓ of your net movable estate.

Your Children - are entitled by law to ⅓ of your net movable estate.
You have free disposal of the remainder.

Your Surviving spouse is entitled by law to life enjoyment of ⅓ of your immovable estate.

 

 

'Surviving spouse' includes husbands, wives and civil partners but not unmarried or 'common law' partners.

'Children' includes legitimate, illegitimate and adopted children (but not step-children).

What would happen if I don't leave a Will?

Status Movable Estate Immovable Estate
Single

Your heirs (usually your brothers and sisters) will receive your movable estate in equal shares.

An unmarried partner will not inherit.

Your heirs (usually your brothers and sisters) will receive your immovable estate in equal shares.  
An unmarried partner will not inherit.

Single with children Your children will receive the whole of your movable estate in equal shares. Your children will receive the whole of your immovable estate in equal shares.
Married/civil partner without children Your surviving spouse will receive the whole of your movable estate. Your surviving spouse will receive the whole of your immovable estate.
Married/civil partner with children

Your household effects plus personal estate up to £30,000.00 will go to your surviving spouse.

The remainder will be divided 50 percent to your surviving spouse and 50 percent to your children.

Life enjoyment of the matrimonial home will be given to your surviving spouse.

Ownership will be divided equally between your surviving spouse and your children.
